Terms & Conditions

To protect your own interest please read our terms and conditions carefully. These apply to all transactions on www.kasakosa.com (a website run by Kasakosa ltd). When purchasing from us you enter into a legally binding agreement therefore, you should understand these conditions as they affect your rights and liabilities. Use of our website and any purchase of our products means that you accept our terms and conditions. This does not affect any statutory rights you may have. Please read them carefully and keep a copy for your reference.

Definitions

The company means Kasakosa ltd. The customer or you, means the person who buys or agrees to buy goods from the company.

Description of goods

We, the people of Kasakosa, have tried to describe the products as informatively and accurately as possible. Sometimes it may not be possible to publish detailed specifications of all products. Please contact us for this information. There may be times when size, colour, content or presentation of products may be changed by the manufacturer beyond our control. All product specifications, images and information published on our website has been created by ourselves. All rights reserved.

Payments

Orders must be paid for before delivery. Payments are accepted by all major credit or debit card (Visa, Mastercard, American Express, Delta, Switch or Solo) and also Paypal or, by post with personal cheque or postal order. Please make cheques payable to Kasakosa ltd and enclose a copy of your order and your contact details and delivery address. Any payment sent by post must be adequately insured. We cannot take responsibility for payment lost in the post. Payments made by cheque require 5 working days to clear prior to despatch. If your address is outside the UK and you order on line you must pay by credit card. All prices on our website are inclusive of VAT but exclusive of delivery charges. Any incorrect information will cause delay in processing your order. Your order will only be processed once your payment has been authorised.

Currencies

www.kasakosa.com currently only sells online in GBP. If you require a quote or payment in any other currency please contact us using the contact form on this website.

Availability

We will endeavour to keep the website updated on a regular basis but, cannot guarantee that a particular product will always be available and may be withdrawn at any time. If we are unable to supply the goods we will not charge you for them and will refund any money already paid. We will not be held liable for any other losses you may suffer if we do not supply the goods. All offers are available while stocks last.

Delivery

We will deliver to anywhere inside and outside the UK. Delivery of goods will normally be made within 2-4 working days from clearance of payment. Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and the company shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. The risk in the goods shall pass from the company to the customer upon delivery of the goods. Please allow any lead time to avoid disappointment resulting from the delivery time. This does not affect your Statutory Rights as a consumer.

Ownership and risk

The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer. We will only deliver goods to the address on the order. Any transit damage, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.

Delivery charges

All prices on our website are exclusive of delivery charges that will be added to the total costs of your goods at the checkout. For further details on our shipping policy please follow the link.

Delivery in the UK

All items will be delivered by Royal Mail or via a courier service. Delivery charges are calculated at the checkout and displayed clearly. For any parcels that exceed 2kg we will use a courier. There will be a minimum charge of £5.00.

Delivery in Europe

There is a standard charge of £5.00 postage and packing, delivery charges are calculated at the checkout and displayed clearly. You may be subject to local import taxes which are wholly your responsibility when they apply. We do not know what they are and cannot be held responsible for them in any way.

Damages and shortages

The customer shall report any damage or shortage to the company and carriers within 7 days of delivery. Provided prompt notice of transit damage or loss is given and provided it is proved to the company’s satisfaction that such damages occurred in transit within the UK but not otherwise, the company will refund, repair or replace such equipment free of charge to the customer. Any shortages or incorrect goods must be notified immediately and it will be your responsibility to do so. We will not accept liability for goods lost in transit and it is your responsibility to notify us immediately.

Returns

If you are not completely satisfied with your purchase, simply return the item to us in its original condition within 7 days of receipt. Returned items should be unused and must be returned in original packaging with the correct documentation. We will issue a full refund upon receipt, excluding the original delivery charge. Alternatively, if preferred, we will exchange the item.

Force Majure

The company will not be liable for any breach of agreement, for the delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, legislation or other cause beyond the companies reasonable control. This does not affect your statutory rights. If the company chose not to enforce a right under this agreement, that decision will not prevent the enforcement of other rights, or the same right on a later occasion.

Liability

Under no circumstances shall the company be responsible for any indirect, incidental or consequential damages.

Distance Selling Regulations

The terms and conditions of sale detailed below are provided for your information, in line with legislation contained in Consumer Protection (Distance Selling) Regulations 2000. This legislation covers items bought where there is no direct contact between supplier and the consumer. It does not apply where goods are bought for business use, from showrooms, fairs or exhibitions. Your contract is with:

Distance selling regulations allow for a cooling off period of 7 days from receipt of goods covered under the legislation. Customers may return specified goods without reason within this period for a refund. This excludes goods made to the consumer’s specifications. Goods returned have to be unused, complete and in A1 resalable condition including original packaging. The cost of returning and appropriately insuring the goods until satisfactory receipt at the company will be borne by the customer. To cancel the contract under the terms of Direct Selling legislation with the company Kasakosa ltd must be contacted in writing at the above address within 7 days or receipt of the goods. The customer will be required to return the goods to the company before a refund can be processed. The company cannot be held responsible for goods returned without proper identification.

Any information collected will be treated with the utmost confidentiality and will not under any circumstances be passed on to a third party.
